The Appeals Court of Montenegro has revoked the high court’s decision to approve Terra founder Do Kwon’s extradition to either the U.S. or South Korea.
According to the official release of December 19, the Appellate Court of Montenegro has accepted the appeal from the defense attorneys of Do Kwon and rejected the High Court’s decision to extradite Kwon.
The decision from the appeals court came after the Montenegro high court approved Kwon’s extradition request on November 24, which was dramatically appealed by Kwon earlier this month.
While revoking the decision, the panel of the Court of Appeals stated that the High Court’s decision does not have reasons for decisive facts, and the reasons given are unclear, “which is the reason for its cancellation.” As per the official release, the case has now been sent back for retrial.
Kwon was detained and arrested in Montenegro in March 2023, and since then he has been under investigation over charges of attempting to falsify documents in order to leave the country.
The U.S. and South Korea, however, have requested the Montenegro government extradite him to their country as he faces a lawsuit over the crash of the multi-billion dollar project Terra (LUNA).
