Lawyers representing Do Kwon, the former CEO of Terra, have officially asked a U.S. court to delay the SEC trial that involves him and his previous company, as it is based on the unpredictability of the timing of his extradition from Montenegro.
According to the filing, the extradition process in Montenegro is facing delays, and it is anticipated that Kwon may not be in the United States until at least February or March. This information was initially noted by Inner City Press.
If the Court decides not to delay the trial, Kwon’s lawyer requests that the jury be told to consider his absence and inability to testify as “not unduly prejudicial to him.” The trial is set to commence at the end of January.
Kwon’s extradition proceedings have hit a snag, as his legal team has effectively challenged a Montenegro high court ruling to extradite him to either the U.S. or South Korea. The Appeals Court has intervened, mandating a retrial on account of procedural concerns.
