Pennsylvania environmentalists top the bill for a new lawsuit against crypto mining operations by bringing an old constitutional right into the exercise, the Environmental Rights Amendment.
According to Bloomberg, this lawsuit becomes the first among in the United States to apply a right to nature, through a state’s constitutional provision on a clean environment, against cryptocurrency mining practices.
Save Carbon County has sued Fast and the Furious company, claiming they polluted the environment and caused harm through their crypto mining activities. The company Digital Mining runs two power plants in Pennsylvania to provide energy for its mining activities.
This in turn results in six million metric tons of carbon pollution, created when waste coal and old tires are burned.
One of the lawsuits cited is the Environmental Rights Amendment, which is in the Pennsylvania Constitution. Hence the government becomes an agent of environmental qualities.
This provides the right to a clean environment to all the citizens of the state. This legal strategy focuses on prioritizing environmental concerns over interests in shaping state policies.
