Coinbase’s legal chief, Paul Grewal, accused the SEC of inconsistency in their most recent filing. The SEC argued against Coinbase’s request to file an interlocutory appeal, while the SEC requested a similar appeal in the Ripple Labs lawsuit.
In April, Coinbase filed a motion to dismiss the lawsuit brought by the SEC. The exchange took up a position that the SEC’s claims were wrong and reiterated the dismissal of the lawsuit. Coinbase then moved the court for a rehearing, after the judge denied its motion.
Later on, Coinbase requested permission to appeal the decision. The SEC maintained that the case cannot currently be reviewed before the US Courts of Appeals because the case is not yet ready for appellate review.
Grewal posted on x stated that the SEC’s approach is contradictory and called for “honest conversations” between the regulator and the exchange.
“Let’s at least have an honest conversation. Forget about a split across agencies, circuits, and elsewhere. There’s not even a consensus about Howey and digital assets among the district judges in the same courthouse at Foley Square. ”He stated.
